Terms of Service

1. Agreement

These Terms of Service (the "Terms") govern your access to and use of Tracklist, a mobile application and related services operated by Tracklist, Inc. ("Tracklist," "we," "us," or "our"), a company headquartered in Los Angeles, California. By creating an account or using Tracklist, you agree to be bound by these Terms and by our Privacy Policy.

2. Who can use Tracklist

You must be at least 13 years old to use Tracklist. If you are under 18, you may only use the service with the involvement of a parent or legal guardian. By using Tracklist, you represent that you meet these requirements and that the information you provide is accurate.

3. Your account

You are responsible for the activity that happens under your account, including the content you post: ratings, reviews, photos, comments, and anything else you contribute. Keep your login credentials private. Tell us promptly if you suspect unauthorized use.

4. Your content

You keep ownership of the content you post on Tracklist. By posting, you grant Tracklist a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content within the service so we can operate and improve it. You can delete your content at any time, which terminates this license for future uses (subject to standard backup retention).

6. Third-party content

Tracklist shows information about live events, venues, and artists sourced from third parties. We don't guarantee its completeness or accuracy. Anything you do with that information (buying tickets, traveling to a show) is at your own risk and subject to the terms of the third parties involved.

7. Intellectual property

The Tracklist name, logo, design, software, and all related materials are owned by Tracklist, Inc. and protected by intellectual property laws. You may not copy, modify, or create derivative works from any part of the service except as expressly permitted.

8. Termination

You may stop using Tracklist and delete your account at any time. We may suspend or terminate your access if you violate these Terms, or if we discontinue the service. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, governing law) will remain in effect.

9. Disclaimers

Tracklist is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Tracklist, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim related to the service is limited to the greater of one hundred U.S. dollars (USD $100) or the amount you paid us in the twelve months before the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of Tracklist after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. The exclusive venue for any dispute that is not resolved informally is the state or federal courts located in Los Angeles County, California.
